Virus & Spam Filtering - by default we virus and spam
filter every email that comes in or goes out of our mail server (this can be
changed by request) to make sure it is virus and spam free. However, no virus
or spam filter product can guarantee that it will catch 100%. Therefore, we
suggest that you run additional virus filtering on your own system with
products such as Norton Antivirus and Norton Internet Security.
We are not responsible for legitimate emails that are
discarded by our spam filtering. It is still the user’s responsibility to have
current virus protection software installed on their computer. We accept no
responsibility for damages a virus does to your computer that may not be
filtered by our virus scanning system. Basic spam filtering is always active
and can not be disabled. Only email to an email address on our mail server is
checked. If you have email addresses
from systems such as Hot Mail or Yahoo they are NOT scanned by our spam and
virus filter.
Unlimited Access - The Services are intended for personal periodic, active use of e-mail, newsgroups,
file transfers, Internet chat, games, and browsing the World Wide Web and not for high volume or commercial use.
Users may stay connected so long as they are actively using that connection for the above purposes.
Users may not use the services on a standby or inactive basis in order to maintain a connection.
Accordingly, we maintain the right to terminate any user connection following any extended period of (in)activity as determined by us.
These accounts are sold on a single user/connection basis and simultaneous logins are not allowed. All prepaid access is non-refundable.
Service Rates - User acknowledges that the nature of the service furnished
and the rates and charges have been communicated to the user. User is
aware that we may change the specified rates and charges from time to time. The
promotional offer of $9.95 is contingent upon us achieving and maintaining our
cost of service goals including but not limited to rates charged to us by our
suppliers.
Payment and Fees - Charge backs for any reason are
subject to a $50.00 charge. Credit cards that are declined for
any reason are subject to a $10.00 declination fee. Service will be interrupted
on accounts at the end of pre-paid access. Service interrupted for nonpayment
is subject to a $10.00 reconnect charge. Accounts that are not collectable by us
may be turned over to an outside collection agency for collection. If your
account is turned over for collection, you agree to pay us a "Processing
and Collection" Fee of not less than $50 nor more than $150. If you desire
to cancel your account, please follow the proper procedure to do this as
outlined in the TOS. If you dispute a charge to your credit card issuer that,
in our sole discretion is valid under the provisions of the TOS, you agree to
pay us an "Administrative Fee" of not less than $50 and not more than
$150.
Contract - There is no contract or minimum term commitment. However, any
and all payments made to us are non-refundable.
Payment Due Date - Establishment of service is dependent
upon receipt of payment of stated charges. Subsequent payments are due on the
anniversary date of the month for that month’s service.
Refunds and Disputes - All payments made to us are non-refundable.
This includes additional services, and subsequent charges regardless of usage.
All overcharges or billing disputes must be reported within 45 days of the time the dispute occurred
Failure to Pay - We may temporarily deny service or terminate this
Agreement upon the failure of user to pay charges when due. Such termination
or denial will not relieve user of responsibility for the payment of all
accrued charges, plus reasonable interest and any collection fees
Account Cancellation - For your privacy and
protection, all requests for canceling accounts must

please let us know when you call as our goal is keep everyone smiling !
Cancellation requests by email or by telephone will not be accepted. Once we
receive your letter a cancellation number will be given to you as proof of
your cancellation. This process is in place to also protect you from others
who might attempt to cancel your account without your knowledge.
The use of your account by anyone is acknowledgement that you accept these
terms and conditions. Your responsibility for prepayment of access shall
continue until we receive written notification, sent by way of the U.S.
Postal Service, of your desire to terminate your access. At that time we
will mark your account not to renew at the end of the current prepaid period
of access.
Scope of Technical Support - We limit our technical
support to our area of expertise. Your modem must already be physically
installed and configured for your operating system. If your modem is not
configured you will need to contact your computer supplier or computer tech to
have the modem configured prior to you giving us a call. You system must be
running Windows 95 or a more recent version and your computer system must have
a Pentium or more recent CPU with at least 16 megs of memory.
When you setup your new account with us we will help you with the necessary
dialup software settings for your individual system to get it connected to the
Internet. When you call for setup support you must have the Windows install
CD-Rom and the model and manufacturer of your modem.
We will be glad to answer over the telephone any ISP system related questions.
For those of you that purchase replacement computer systems you should
request your computer supplier to setup your dialup software before you take
delivery. We will gladly supply to you or them the settings needed to setup
your connect it to the Internet. That information is also on our web site.
If you chose not to have your computer supplier or computer tech setup your
dialup connection information then you should download and/or print the step
by step graphical setup instructions from our web site before your change out
or disable your existing computer system. That is the only way that you will
be able to make the settings in your new system when you are not yet able to
connect to the Internet. You will find graphical step by step setup instructions
for several POP3 email clients on our support web site.
Telephone Charges - We are not responsible for tolls
acquired from long distance dialing. It is your responsibility to call your
local phone company to determine if the number you will use to access our
network is a local call
User acknowledges that the service provided is of such a nature
that service can be interrupted for many reasons other than the negligence of
the company and that damages resulting from any interruption of service are
difficult to ascertain. Therefore, user agrees that we shall not be liable for
any damages arising from such causes beyond the direct and exclusive control of
us. Subscriber further acknowledges that our liability for its own negligence
may not in any event exceed an amount equivalent to charges payable by user for
services during the period damages occurred. In no event shall we be liable for
any special or consequential damages, loss or injury. We reserve the right to
cancel users rights under this contract at anytime without further obligation.
Revisions to this Terms of Use Policy - We reserve the right to revise,
amend, or modify this TOS (Terms of Service) and our other policies and agreements at any time and in any manner.
Notice of any revision, amendment, or modification will be posted in accordance with our TOS (Terms of Service).
